Emphyteutic lease is a type of real estate contract. An Emphyteutic lease specifies that with the construction, the lessee must improve.

Emphyteutic lease is usually used in Quebec. The Roman Law is the origin of the the emphyteutic lease. On the productive real estate the Law of Emphyteusis is charged. On some conditions like taking care of the property or estate, paying its small rents and by paying its taxes, the right is linked with the enjoyment of the property. This law was practiced during the time of colonization in the few colonies of South America. Initially, this law was practiced by the state for agricultural purposes or construction of building on land.

To an emphyteutic lessee, it contains right of a usus, abusus and fructus. Such a lease typically includes, an immovable, right to make full use of immovable, from the agreement the stipulated term and finally, it belongs to the land owner at the end of emphyteusis obligation to make improvements for promoting the building to high standard. It is basically created for 10 - 100 years terms. The real rights of usus, abusus, and fructus are given back to the owner when the lease ends.
